In many respects, an insurance policy is a basic contract, no
different than any other contract you can image, such as a contract
to buy a car, a real estate contract, an employment contract, etc.
All contracts have "terms and conditions," which spell out what
either side of the contract has to do, what they have to provide,
how they have to behave with respect to the other party in the
contract, etc. The terms and conditions of a contract are the basic
rules by which the parties to the contract have to abide. The terms
and conditions also contain the benefits that are provided by the
contract. For example, a benefit that may be available under an
insurance contract (the policy) could include payment for medical
expenses or property damage. However, those same terms and
conditions may require certain things be in place before any
benefits have to be paid. Paying your insurance premiums in a
timely manner is certainly a condition that must be meet before your
insurance company has any obligation under the contract to pay you
benefits.
Some aspects of insurance contracts must comply with various Florida
Statutes, while other terms and conditions can be included in an
insurance policy at the discretion of the insurance company. For
example, many aspects of your automobile insurance policy are
directly controlled by laws in our state, such as the Florida
Financial Responsibility Act.
In some cases, insurance polices and the laws of our state allow for
an insured (you) to get your attorney's fees and costs paid by the
insurance company if you prevail in a lawsuit. In other disputes,
there are no automatic provisions for payment of attorney's fees or
costs. It will depend on the type of insurance policy and the
nature of the dispute.
