What is a Contingency Fee?
A contingency fee is a fee that is not collected until you make a
recovery on your case. In other words, the lawyer agrees to
represent you and handle your claim. The lawyer agrees that he will
not charge you any fee unless he makes a recovery for you. This
recovery might be by an out of court settlement or by a jury verdict
if the matter has to go to trial. If there is no recovery, or the
case is lost for whatever reason, you are not obligated under the
provisions of most contingency fee contracts to pay the lawyer
anything for attorney's fees.
In other words, we take all of the risk concerning legal fees. If we
do not recover money for you, you do not pay any legal fees.
Our office will work under a contingency fee contract on the vast
majority of personal injury and negligence cases. Criminal cases,
and some other civil disputes, require payment of attorney's fees in
order to retain our services. Criminal cases are handled on a flat
fee basis, with the amount determined on a case by case basis.
Other civil cases are usually handled by the hour, meaning our work
is billed by the amount of time spent working on the case.
Costs in personal injury and negligence cases are also advanced by
our office. Costs can be incurred for such things as medical
records, paying experts, conferences with doctors to discuss a
client's medical care and injuries, court filing fees, etc. There
is no set amount for costs and they can vary depending on the
complexity of a case. Again, our office does not, in the vast
majority of cases, require any deposit of money for costs. Instead,
costs are reimbursed if we are successful in prosecuting your case
and obtaining either a settlement that you authorize or a jury
verdict. Prior to concluding any case, we will take the time to
provide you a breakdown of any offers made by a defendant to settle
your case. That way you can have an idea of what amount of a
settlement will go to you personally after all fees, bills and costs
are paid. We cannot resolve a case unless we have the client's
permission.
Overall, we believe it is important that our clients understand that
we will do all that we can to obtain the best possible result in any
case. We will never incur costs needlessly, however, we also will
never attempt to settle a case simply because an offer has been made
and we can get paid. Our office has the resources and experience to
pursue any case we agree to take on, regardless of how simple or
complex. We have the resources and financial ability to go "toe -to
toe" with the defendants and insurance companies we sue and we will
expend those resources on behalf of our clients in order to
successfully present a strong and compelling case. At the same
time, we will provide you with honest and professional opinions
regarding your case.
In Florida, contingency fee contracts are regulated by the Florida
Supreme Court and a lawyer is prohibited from charging an excessive
fee. Our office complies with the rules of the Florida Supreme
Court concerning fee contracts. If you have any questions or
