Certain tickets issued by a police officer are considered
"criminal" offenses. Others are considered "civil infractions."
Tickets for speeding, broken taillight, or other equipment problems,
careless driving, etc., are civil infractions that do not carry the
possibility of jail or probation. They can result in fines, court
costs and points on your driving record. A lawyer may still be of
assistance to you for any ticket, even a civil infraction.
Criminal traffic tickets are much more serious and should definitely
be handled with the assistance of a criminal traffic attorney.
Criminal traffic tickets can include charges such as Driving Under
the Influence (DUI), Reckless Driving, Driving with a Suspended
License (DWLS), and Leaving the Scene of an Accident with Injury.
These kind of charges, brought by the State Attorney's Office,
require a court appearance and cannot simply be resolved by paying a
fine to the Clerk of the Circuit Court in your county. They can
also result in probation supervised by the Department of Corrections
or the Salvation Army, which handles misdemeanor probations. They
can result in jail time, depending on the severity of the charges,
the person's criminal record, and other potentially aggravating
factors.

Influence arrest. We also know how to deal with someone who has
a bad driving record, with prior traffic tickets and a suspended
license.
In most cases, we will appear on your behalf and tell the court that
you plea Not Guilty. This will give us the opportunity to demand
discovery from the State Attorney's Office. Discovery may include
copies of the police reports, breath test results and paperwork,
video tape of the Field Sobriety Tests, witness statements, etc. We
will review all of the information and consult with you in order to
determine which direction we should go. Each case is different,
some should be resolved in a plea bargain, some should go to a jury
trial. Some cases are resolved via Motions To Dismiss, or Motions
to Suppress Evidence, when law enforcement has failed to comply with
the law. Regardless, your attorney will be there with you each step
of the way, trying to keep your time away from work and family to a
minimum, working on your case, exploring all of your options and
pursuing a defense on your behalf.
