IMPROPER HIRING AND RETENTIONThis type of case deals with a person employed in a job that allows the person to somehow come into contact with another, and in the course of that contact, causes injury to another. Examples may include a maintenance workers with a criminal history and whose job allows him access to a victim's home. If that workers commits a crime against a customer, renter, etc., his employer could be held responsible for damages as a result of negligently hiring someone with a criminal background, one that indicates he is a possible danger to the community. If someone has a history of poor job performance, dishonestly, violence, theft, etc., an employer could be held responsible for that person's actions while in the course and scope of his employment. If someone has been kept on a job, despite a history of problems that indicate he could be a potential danger to customers, again, the employer could be held responsible for damages caused by that employee.
The above briefly points out some of what can be involved in an
