Many attorneys who handle cases on a contingency fee basis or by charging an hourly rate for their services require their clients to pay the expenses or costs of bringing the claim. However, we recognize that many people are unable to bear the costs of bringing a claim. Therefore, under our contingency fee contracts, and absent any unusual circumstances, we advance all of necessary costs to be incurred in bringing the claim.
Generally, the type of costs that are usually involved in bringing
a personal injury case includes the costs of obtaining accident
reports, medical reports, long distance telephone charges, postage,
photocopying, investigative services and, if a lawsuit needs to be
brought, the cost of filing fees, court reporters, charges for
expert witnesses and exhibits for trial.
In most all instances, if there is no recovery, our firm does not seek reimbursement of any costs from our clients. In this regard, our office takes all the financial risk in presenting our client's personal injury case. We advance costs and do not get any advance payment of attorney's fees, such as a retainer payment. If we are successful in prosecuting your case, then we get reimbursed for the costs that we have paid out on your case and we get paid our attorney's fees. If we are not successful, and no recovery is made, you do not owe us anything. With this in mind, you can rest assured that we will always try our best to obtain a satisfactory recovery in your case. Likewise, we will always be honest with you concerning the risks and potential benefits of settlement vs. trial and whether the potential costs involved in your case are worth the expense, when considering the value of the case and the potential for a successful outcome at trial. In other words, we will incur costs that we believe are necessary in presenting a strong and convincing case and not simply spend money needlessly, since the costs will ultimately come out of your recovery anyway. Our goal is to maximize your personal recovery, i.e., the money you receive personally, after all bills, fees and costs are paid, and to incur costs in a reasonable fashion in an effort to do so.
However, as stated under our "Contingency fees" page, Kinney,
Fernandez & Boire has the financial ability and willingness to incur
whatever costs are necessary to present our client's case. This
includes such expensive activities such as hiring recognized expert
witnesses, creating dynamic exhibits, models, photographic
enlargements, using the services of private investigators, etc.
Lastly, at Kinney, Fernandez & Boire, we are always willing to
discuss the costs in your case. We will always be willing to
discuss any concerns that you have and will do our best to resolve
any issues. As we have stated, customer service is as important in
our field as any other service industry. Therefore, as our client,
we will do all that we can to satisfy your wishes.
