NECK AND BACK INJURY CASESOften the resulting injuries of car accidents and slip and fall accidents, neck and back injuries can run from what is called "soft tissue," or muscular related injuries to injuries involving bulging or herniated discs.
Neck and back injuries often require treatment involving physical or
chiropractic therapy, along with diagnostic testing such as Magnetic
Resonance Imaging (MRI). From a legal standpoint, it is important
to properly address neck and back injuries with expert testimony.
Many people have changes and abnormalities in their spine due to
age, other accidents, etc. These changes are often referred to as
Degenerative Disc Disease, or "preexisting conditions." Therefore,
it is important to obtain clear documentation of what, if any,
injuries were caused by a particular accident, as opposed to being a
condition that existed before a particular accident or is otherwise
unrelated to an accident.
Also, it is important to determine if a neck and back injury is
considered a "permanent injury" under the American Medical
Association Guidelines for Permanent Impairment. For instance, in
most cases a Permanent Injury must be proven before a victim of a
car accident is entitled to damages for pain and suffering.
A neck and back injury from an accident can also involve an
aggravation to a preexisting condition, such as when someone has
aging related changes in their neck or back that were not causing
any problems before an accident, but after, does become
problematic. Often times, victims of accidents have suffered what
is considered a permanent aggravation to a preexisting condition.
Damages from neck and back injuries can include medical expenses,
lost wages, lost earning capacity (the ability to earn money in the
future), and pain and suffering.
