All of us living in the United States are privileged to live in a country where each individual is guaranteed certain constitutional rights.  In criminal cases the courts have determined that individuals who have been charged by the government with a crime have rights, not only to protect them, but all of society.  At Kinney, Fernandez & Boire we understand that each individual has constitutional rights and we have the experience to represent individuals who have been charged with a crime.

Our staff of attorneys includes Rob K. Roy, a former state prosecutor who worked for the Hillsborough County State Attorney's office in Tampa, Florida.  As a criminal prosecutor, Mr. Roy prosecuted thousands of cases involving  felonies, misdemeanors and criminal traffic charges.  His successful prosecutions included cases involving attempted murder, drug trafficking, habitual felony offenders and numerous other serious criminal cases.  In addition, Mr. Roy worked closely with law enforcement officials from the Tampa Police Department, Hillsborough County Sheriff's Office, the Federal Bureau of Investigations (FBI), the Federal Drug Enforcement Agency (DEA), and the Florida Department of Law Enforcement (FDLE).  He assisted and participated in the execution of search warrants and with ongoing investigations.  Several of his prosecutions resulted in media coverage.  All of our attorneys have years of experience practicing law and have appeared numerous times in criminal defense matters.

Criminal cases handled by Kinney, Fernandez & Boire include felonies, misdemeanors and criminal traffic cases.  Felonies involve such crimes as possession of drugs, sale and distribution of drugs, grand theft, burglary, resisting arrest with violence, battery on a law enforcement officer and any other crime that can result in more than one year of imprisonment.  Misdemeanors involve crimes punishable by less than one year incarceration, such as simple battery, domestic battery, petit theft, simple possession of marijuana, worthless check and resisting arrest without violence.  Criminal traffic cases involve crimes such as driving under the influence, driving with a suspended license and reckless driving.  Criminal traffic cases can be filed as misdemeanors or felonies, depending on various factors and a person's driving history.

One of the things that separates Kinney, Fernandez & Boire from other criminal defense law firms is that we intentionally do not take on a high number of criminal cases.  Rather, we choose to keep our criminal practice small in order to provide top notch service and attention to our criminal clients.  We feel that a high volume criminal practice often results in less individual attention, and as a result, a client may not feel as confident in his or her representation.  At Kinney, Fernandez & Boire, we seek to strike a winning balance between experienced criminal representation and a limited number of criminal cases so that our criminal clients can feel confident that all possible defenses and options are pursued without hesitation and without any constraints from lack of time or from taking on too many criminal cases at one time.  In our office, you will always deal personally and confidentially with a lawyer.   In many cases, your lawyer can appear in court on your behalf and you will not have to attend all court proceedings, so as to avoid missing time from work, school, family and other obligations.  We will advise you well ahead of time when a court hearing does, in fact, require your attendance.

Regardless of experience and hard work, no lawyer can guarantee the outcome of a criminal case.  The simple act of hiring a lawyer does not automatically mean that a person charged with a criminal offense is going to receive a plea bargain or be found not guilty.  At Kinney, Fernandez & Boire, we do all that we can to review and investigate each criminal case from beginning to end to ensure that constitutional rights have not been violated and to determine if the government has sufficient evidence to prove the case to a jury beyond a reasonable doubt.  Our job is to provide you with the most options while facing a criminal charge.  Personal attention is paid to each criminal case and time is taken to answer all of your questions and address all of your concerns.

Our prices are reasonable and we will consider payment plans.

At Kinney, Fernandez & Boire, our criminal practice is given the attention it deserves.  From the initial discovery stage and investigation, to filing motions and conducting legal research, to picking juries and going to trial, our office will spare no effort in zealously and ethically representing our clients charged with a criminal offense.  With 5 convenience locations and over 100 years of combined experience, let us put our team to work for you.
